2. Scope of Service

SeaEO-Tours provides boat tours and marine observation experiences in the Lisbon region, Portugal. Our services are delivered exclusively within Portuguese territory but are available for purchase by clients worldwide.

The website is available in Portuguese, English, and French, and all prices are displayed in Euros (€).

There are no geographical restrictions on bookings; however, the service itself is conducted in Lisbon.

3. Nature of Services

Our offerings are leisure and tourism services, specifically guided boat tours and marine wildlife observation.
Customers can book and pay online for tours on their chosen date and time.

The website may feature user-generated content such as customer reviews and testimonials. SeaEO-Tours reserves the right to moderate or remove any content deemed offensive or misleading.

4. Pricing, Payments and Promotions

4.1 Prices

All prices are listed in Euros (€) and include VAT at the legal rate in force.
Should you chose to book using our Fareharbor system on this website, a fee may be applied.

SeaEO-Tours reserves the right to change prices or offer temporary promotions, which will be clearly identified on the website. Promotions are not retroactive.

4.2 Payments

Payments are securely processed through FareHarbor, which uses Stripe and/or PayPal as payment processors.
All transactions are encrypted and handled through a secure connection (SSL).
SeaEO-Tours does not store any customer payment information on its own servers.

4.3 Booking Confirmation

A booking is confirmed only after full payment has been successfully processed. Customers will receive an email confirmation with booking details. If you do not recieve an email with the booking details, please check your spam folder or contact us.

5. Cancellations, Refunds and Re-scheduling

5.1 Customer Cancellations

  • Cancellations made at least 24 hours before the scheduled departure are eligible for a full refund with no penalty.
  • No-shows (failure to appear at the departure point on time) are non-refundable.
  • The vessel departs at the scheduled time with a maximum delay tolerance of 5 minutes.

5.2 Operator Cancellations

SeaEO-Tours may cancel or reschedule tours due to unforeseen circumstances (e.g. adverse weather conditions, insufficient number of passengers, safety concerns).
In such cases, customers may choose between:

  • a full refund, or
  • a credit voucher to rebook another date.

5.3 Minimum Passenger Requirement

A minimum seats must be booked for a tour to proceed. If this threshold is not reached, customers will be contacted to reschedule or request a refund. SeaEO-Tours may chose to work with partners nearby who carry out the same activity if the minimum number of clients is not met.

6. Participation Restrictions

For safety and comfort reasons:

  • Children under 5 years old are not permitted.
  • Pregnant individuals are not permitted.
  • Participation is not recommended for persons with severe back or hip problems.
  • Participation is not recommended for persons with recent surgeries or neck problems.
  • Participation is not recommended for individuals weighing over 150 kg / 330 lbs, due to seat limitations.
  • Clients that show sighs of excessive usage of alcohol or ilegal substances, such as drugs, will not be allowed on board.

SeaEO-Tours reserves the right to refuse participation if safety concerns arise.

In the case of a no-show at the departure time, SeaEO-Tours has the right to occupy the available places with other clients in the waitlist.

7. Limitation of Liability

SeaEO-Tours aims for a 97% success rate in dolphin watching; however, sightings cannot be guaranteed as they occur in a natural environment.
No refunds will be provided if dolphins or other wildlife are not observed.

SeaEO-Tours shall not be held liable for:

  • delays caused by external factors (traffic, weather, port restrictions);
  • personal items lost or damaged during the activity;
  • injuries or incidents resulting from non-compliance with crew instructions.

Customers are responsible for ensuring they are physically fit for participation.

8. Data Protection and Privacy

SeaEO-Tours respects the privacy of all users and customers.
Personal data collected during the booking process includes full name, phone number, email address, and preferred language.

8.1 Data Processors

  • FareHarbor (booking and payment management)
  • Google Analytics (anonymous traffic analysis)

Both operate as data processors (sub-contractors) under Article 28 of the GDPR.

8.2 Data Use

Data is used solely for:

  • managing bookings and providing the service;
  • contacting customers regarding their reservations;
  • improving the quality of services through analytics.

No personal data is sold or shared for marketing purposes.

8.3 Privacy Policy

9. Image and Video Rights

During SeaEO-Tours activities, our crew may capture photographs and video recordings — including aerial footage using drones — for promotional, marketing, and internal documentation purposes, as well as for use in commercial partnerships or campaigns (e.g. with tourism boards, agencies, or media partners).

These recordings may include participants and boats visible during the experience.

9.1 Consent and Use

By participating in any SeaEO-Tours activity, customers acknowledge and agree that their image, voice, or likeness may appear in photographs or videos captured during the tour.

Such materials may be used, reproduced, adapted, or published by Econauturismo, Lda. (SeaEO-Tours) in any format — including, but not limited to:

  • the company’s website and social media channels,
  • printed or digital marketing materials,
  • advertising campaigns and media collaborations,
  • audiovisual content used in promotional events or by tourism partners.

All captured content remains the exclusive property of SeaEO-Tours, and participants waive any right to compensation, royalties, or approval regarding its use.

9.2 Opt-Out Procedure

SeaEO-Tours fully respects the privacy and preferences of its guests.
Any customer who does not wish to appear in photos or videos must inform the crew before or during the tour.

Our team will take reasonable steps to avoid filming or photographing that person or to exclude them from identifiable footage whenever possible.
However, given the open and public nature of maritime activities, complete exclusion cannot always be guaranteed.

9.3 Drone and Aerial Recordings

SeaEO-Tours occasionally operates unmanned aerial vehicles (drones) to capture footage of its tours and the surrounding maritime environment.

All drone operations are carried out:

  • in accordance with Portuguese law,
  • under the supervision of licensed pilots, and
  • in compliance with the safety and privacy regulations established by the National Civil Aviation Authority (ANAC).

Aerial footage is limited to public and open spaces, and no targeted or intrusive filming of individuals is conducted.

9.4 Copyright and Intellectual Property

All photos, videos, and audio recordings produced by or on behalf of SeaEO-Tours are the exclusive intellectual property of Econauturismo, Lda.

Customers may not reproduce, distribute, modify, or commercially use any such materials without prior written authorisation.

9.5 Withdrawal of Consent

If, after participating in a tour, a customer wishes to request the removal of identifiable content (e.g. a photo or video featuring them), they may contact us at info@seaeo-tours.pt.

SeaEO-Tours will review such requests in good faith and, where feasible, remove or blur the relevant material from future publications.

10. Intellectual Property

All content on this website — including text, images, videos, graphics, and the SeaEO-Tours logo — is the property of Econauturismo, Lda. unless otherwise stated.

No material from this site may be copied, reproduced, modified, published, transmitted, or distributed without prior written consent.
Any unauthorised use may constitute a violation of copyright or trademark law.

11. Consumer Rights and Dispute Resolution

In accordance with Portuguese Decree-Law 24/2014 (contracts concluded at a distance):

  • Customers may cancel their booking up to 24 hours before the scheduled tour without penalty.
  • Refunds and credits follow the conditions stated in section 5 above.

12. Compliance with Google and Transparency Requirements

In line with Google Merchant Center and advertising policies, SeaEO-Tours ensures that:

  • Terms and Conditions, Privacy Policy and Contact Details are clearly visible and accessible on every page footer;
  • Pricing, refund, and cancellation terms are transparent and accurate;
  • The legal entity responsible for the website (Econauturismo, Lda.) is explicitly identified;
  • Secure payment methods and data protection practices are implemented.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Portugal.
Any dispute arising from the interpretation or execution of these Terms shall fall under the exclusive jurisdiction of the Portuguese courts, with venue in Lisbon.
